You have found a buyer, the purchase contract has been signed, and the sale of the property is officially complete. The legal final step now follows: the transfer at the notary. This is the moment when ownership and payment actually change hands. But how does that process work exactly in Curaçao? What is expected of you as the seller, and what does the buyer do? From purchase agreement to notary
Once the purchase agreement is signed, HomesByYou ensures that the complete file reaches the notary. Think of the purchase agreement, identity documents, cadastral data, and any powers of attorney or leasehold information. The notary checks everything, requests additional documents if necessary, and then prepares the draft deed of transfer.
At this stage, the buyer receives an overview of the costs, including transfer tax (4%), notary fees (approximately 2%), and any financing costs, and must ensure that the purchase price and additional costs are timely deposited in the notary's trust account. The seller mainly needs to remain available and ensure that the property remains in the agreed condition until the transfer.
How long does it take?
A standard notarial transfer in Curaçao takes an average of 10 to 12 weeks. That seems long, but it is necessary for financing procedures, checks with the land registry, document verification, and coordination between buyer, seller, bank, and notary. The day of the transfer
On the day of the signing, the buyer and seller conduct a final inspection of the property. The buyer checks if everything is in the agreed condition: empty, clean, and without new damage. Then comes the official moment at the notary. Once the deed is signed and subsequently registered with the Curaçao Land Registry, the transfer becomes official. Only after that registration and the notary's internal verification, will the sale proceeds be paid to the seller. This usually happens within 3 to 5 working days.
